Land News from Ukraine

A strategy for the development of agricultural sector and a strategy for the sustainable development of rural areas may appear in Ukraine this year. President Viktor Yanukovych said this in an interview with the analytical magazine "Ukraine and the World in 2013. Global Agenda," the press service of the head of state reported.

"They will offer entirely new approaches to public policy in the field of agriculture and rural areas development, based on European principles," he said.

Yanukovych added that the government will deal with improving conditions for investors, especially those who are planning to implement innovative projects in the agricultural sector, as well as reform the food safety control system in accordance with the requirements of the European Union and the World Trade Organization.

The president also said that in recent years much has been done in the sphere of land relations. In particular, the law on the State Land Cadastre was adopted, a legal status was given to the procedure for conducting land auctions, the State Land Bank was established, its legal status and share capital were determined.

"In fact, the process of buying and selling non-agricultural land of state and communal property was unblocked. The issue of delimitation of state and municipal property lands was settled. Procedures for determining the boundaries of settlements, registration and certification of titles to land were simplified," he said.

This year, the State Land Bank will provide farmers with loans at interest rates two times lower than the current rates of commercial banks. And cooperation of the Land Bank with the European Bank for Reconstruction and Development will help attract additional loans for farmers and improve regulation in the turnover of agricultural land, - the press service of the Agricultural Policy Ministry informs.

"Our goal is to get a financial institution that would be involved in mortgage lending and provide to farmers funds at reasonable interest rates. According to our calculations, the interest rate of the Land Bank will fluctuate at 10% per annum, that is two times less than the current rates of commercial banks," Bagrat Akhijanov, director of the financial and credit policies department at the ministry of agrarian policy and food of Ukraine, said.

This year, the Land Bank must already begin its work. However, to fulfill its mission as a specialized agency for mortgage crediting, it is necessary to implement another position - to transfer to the bank the agricultural land that would become the capital to provide cheap loans to farmers. Therefore, on January 1, 2013 an inventory of public lands for agricultural purposes began in order to include them into the authorized capital of the State Land Bank, the statement says.

Moreover, the Land Bank must ensure the implementation of an effective mechanism of state market regulation in the turnover of agricultural land.

"This is not just a commercial bank. It will serve two purposes: commercial - to give farmers loans at 6-8% per annum on the security of land, and economic - to dispose of state land. Therefore, a land bank will be an additional signal to investors about the security of the Ukrainian agricultural sector," Minister of Agrarian Policy and Food Mykola Prysiazhniuk said.

September 6, 2012 the Verkhovna Rada adopted the decision to establish the Land Bank in Ukraine. In October 2012, President Viktor Yanukovych of Ukraine signed Law 5248-VI on amendments to the law of Ukraine on banks and banking concerning the State Land Bank, which defines the mechanism of forming a share capital of the Land Bank. Based on this law, the government has taken appropriate decisions on establishment of the State Land Bank and on approving the State Land Bank statute.

Agricultural workers will soon get credits at 10-15% lower rates against those existing now. This will be possible when the land bank starts working in Ukraine. Primarily, possibility of receiving credits will be profitable for farming enterprises, small and medium-size enterprises. The Agrarian Policy and Food Ministry press service told about this.

“Thanks to legislative and organizational work, the land bank should start fulfillment of its tasks in the nearest future. The financial establishment will promote reduction of the pressure on the state budget, from which a part of the credit rate is compensated now. The state program for cheapening of the credit rate has been working over 10 years in Ukraine, however it does not solve the issue,” the Agrarian Ministry statement reads.

Expert of land relations and President of the Association Land Union of Ukraine Andriy Koshil believes that work of the financial institution will become more effective, if to fix on crediting some agricultural sectors.

“Agrarian crediting is necessary and if the state is engaged in this, the situation existing today may change for the better. However, in order to make it really effective, it is necessary to choose the country's agricultural priority sectors, for instance, dairy cattle breeding. As well as those credits should be extended to farmers, who start working and need financial aid,” the specialist noted.

A decision on the land bank creation was adopted by the Verkhovna Rada last year. Ukrainian specialists, primarily, studied foreign experience and held a number of meetings with representatives of leading world financial institutions.

Activities of the State Land Bank will be started this year. It will provide loans to farmers at interest rates that are twice lower the current rates of commercial banks. And cooperation of the State Land Bank with the EBRD helps to attract additional loan resources for agricultural producers, Government Portal reports.


In addition, the activities will serve to provide an effective mechanism for regulating in the circulation of agricultural land sphere.


After considering the practice of other countries, where land banks exist for years, in Ukraine last year the domestic counterpart of this financial institution has been created. And activities of the State Land Bank will be started this year. Its main purpose is to search for possible ways to reduce interest rates for agricultural producers. In particular, the bank will provide medium-and long-term loans to domestic agricultural producers, affecting the overall credit policy.


“We want to get a financial institution that would be involved in mortgage lending to peasants and provided funds at reasonable interest rates. According to our calculations, the interest rate of the Land Bank will fluctuate at 10% per annum. That is twice lower the current rates of commercial banks”, – said the director of the financial and credit policies and accounting of the Ministry of Agrarian Policy and Food of Ukraine.

However, to fulfill its mandate as a specialized agency for the mortgage, we need to implement another position – to transfer to the bank‘s management agricultural lands that would become the capital to provide cheap loans to agricultural producers. Therefore, from January 1, 2013 an inventory of the state agricultural land has been began in order to introduce them to the authorized fund of the State Land Bank.


In addition, the Land Bank should ensure implementation of an effective mechanism of state regulation of agricultural lands.

A process of the land cadastre formation is a rather long period and experience of other countries proves this. President of the Land Union of Ukraine Andriy Koshil expressed this opinion at a press conference “Peculiarities of Land Titles Registration following January 2013,” held in Kyiv on Wednesday.

“A process for making the land cadastre's complete database will most likely continue over several years. This may continue for five years or, perhaps, seven. In general, such processes, as experience of other countries shows, are really long-term and rather complicated,” Koshil has said.

Among a set of problems, which hamper speeding up the rates of the land cadastre filling, he named delays due to state officials. “Today, it is actually impossible to legally register the land plots, which have been formed before 2004 and have not received cadastre numbers, as well as to continue the term of their rent or to change those terms. In order that this land plot appeared in the cadastre, a cost-based and long period should pass. In the meantime, agricultural producers massively face problems, since they are not able to register or reregister agreements for rent of land plots.”

In addition, President of the Land Union of Ukraine reminded that since December 3 last year, a procedure has disappeared for licensing of subjects and a certification procedure has appeared.

“The Land Agency was obliged to prepare for this procedure, which actually is a technical procedure, over half a month and everyone, having a license, would have to receive a certificate automatically. However, over two months only 10 percent of license holders received certificates. In other words, 80-90 percent of enterprises working in Ukraine cannot fulfill their work now,” Koshil said, adding that “this situation also has a very negative impact on the land cadastre formation.”
